These Terms of Service govern your use of the Tyre Shepherd website and your purchase of products or services from us.
Throughout these terms, “Tyre Shepherd”, “we”, “us”, and “our” refer to Tyre Shepherd. “You” and “your” refer to any person who visits our website, places an order, books a service, or purchases from us.
By accessing our website, placing an order, or booking a service, you agree to these Terms of Service, our Returns and Refund Policy, our Privacy Policy, and any other policies displayed on our website.
Nothing in these terms limits or excludes any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable law.
1. Online store terms
You must be legally capable of entering into a binding contract to place an order through our website.
You agree to provide current, complete, and accurate account, contact, vehicle, delivery, and payment information.
You must not use our products, services, or website for any unlawful, fraudulent, or unauthorised purpose.
2. Product information
We make reasonable efforts to ensure product descriptions, specifications, photographs, availability, and prices are accurate.
Product images are provided for general illustration. Packaging, labels, tread appearance, and other minor details may differ from the images displayed, provided the product supplied remains consistent with its description and specification.
Tyre prices are generally displayed per tyre unless the product page expressly states that the product is sold as a pair, set, package, or bundle.
Product availability is subject to change. Displaying a product on our website does not guarantee that it is currently available.
We will not substitute a tyre for a different brand, model, size, load rating, speed rating, or material specification without your approval.
3. Choosing the correct tyre
You are responsible for checking that the tyre size, load rating, speed rating, construction, and specification are appropriate for your vehicle and intended use before ordering.
Tyre information can usually be found on the existing tyre sidewall, the vehicle placard, or in the vehicle manufacturer’s documentation. Existing tyres may not always be the correct specification for the vehicle, so you should check the manufacturer’s requirements.
Online search tools, vehicle selectors, and compatibility information are provided as guides and may not account for vehicle modifications, optional wheel packages, imported models, or previous changes.
If you are unsure, please contact Tyre Shepherd before purchasing.
If we recommend a tyre after you provide complete and accurate vehicle and usage information, we will take reasonable care to ensure that recommendation is suitable.
4. Orders and acceptance
Submitting an order is an offer to purchase the selected products or services.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean the order has been accepted.
An order is accepted when we confirm acceptance, dispatch the products, begin sourcing a special-order product, or start providing the service—whichever occurs first.
We may decline or cancel an order before acceptance if:

The product is unavailable.

We cannot obtain payment authorisation.

The delivery address is outside our service area.

We reasonably suspect fraud, misuse, or an unauthorised transaction.

The website contained an obvious pricing, description, or technical error.

We cannot lawfully or safely supply the requested product or service.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion using the original payment method.
We may limit quantities where reasonably necessary, including for stock management, safety, suspected resale, or suspected fraudulent activity.
5. Prices and payment
Unless clearly stated otherwise:

All prices are in New Zealand dollars.

Prices include GST where applicable.

Delivery, fitting, balancing, alignment, disposal, and other service charges are additional unless expressly included.

The complete applicable price will be displayed at checkout before you submit your order.
You agree to pay all charges shown and accepted at checkout.
We may correct an obvious pricing error before accepting an order. If an error is identified, we will contact you and give you the option to proceed at the correct price or cancel the affected item for a full refund.
Payment is processed through the payment methods available at checkout. Additional terms from your bank, card provider, finance provider, or payment service may apply.
Ownership of products remains with Tyre Shepherd until full payment has been received. This does not affect when risk passes to you under applicable law.
6. Stock and special orders
Some products may be supplied from a warehouse, distributor, manufacturer, or another Tyre Shepherd location.
Stock information may change between the time you place an order and the time it is processed. If a product becomes unavailable, we will contact you to discuss an alternative, revised timeframe, store credit, or refund.
Special-order and custom-sourced products may require full or partial payment before they are ordered from the supplier.
Once we have begun sourcing a special-order or custom product, it may not be possible to change or cancel the order unless we agree or cancellation is required by law.
7. Delivery and collection
Any delivery or collection timeframe is an estimate unless we expressly agree to a specific date.
We will make reasonable efforts to meet estimated timeframes but delays may occur because of stock availability, supplier delays, freight disruption, weather, events outside our reasonable control, or incorrect customer information.
Tyre Shepherd remains responsible for resolving delivery issues with a carrier arranged by us, as required by applicable consumer law.
You must provide a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to you where reasonable.
You should inspect products promptly after delivery and contact us if anything is missing, damaged, incorrect, or appears unsafe.
Do not fit or use a tyre that appears damaged, defective, or different from what you ordered.
8. Authority to receive deliveries
If you authorise a carrier to leave products unattended, you accept the risk of theft or damage after the products have been delivered as instructed, except to the extent that Tyre Shepherd remains responsible under applicable law.
Where possible, select a secure delivery location and ensure someone is available to receive the order.
9. Fitting and installation
Tyres should be fitted, balanced, inspected, and inflated by a suitably trained tyre professional using appropriate equipment.
Before fitting, the tyre professional should confirm that the tyre specification is suitable for the vehicle and that the tyre, wheel, valve, and related components are safe and compatible.
Once a tyre has been fitted to a wheel—whether at a Tyre Shepherd location, by another tyre shop, or elsewhere—it cannot be returned for change of mind.
This fitted-tyre restriction does not affect your rights if the tyre is faulty, incorrectly supplied, misdescribed, or otherwise fails to meet a guarantee under the Consumer Guarantees Act 1993.
Tyre Shepherd is not responsible for damage caused by incorrect installation, misuse, incorrect pressure, overloading, wheel or vehicle defects, impact damage, racing, unauthorised alterations, or failure to follow manufacturer instructions, unless the relevant work was performed by us or we are otherwise responsible under applicable law.
10. Fitting appointments and services
Appointment times are estimates and may be affected by the condition of the vehicle, additional work required, late arrival, parts availability, or earlier jobs taking longer than expected.
Please arrive at the agreed time and ensure we can safely access and work on the vehicle.
We may decline or stop work if we reasonably believe:

The requested work would be unsafe or unlawful.

The vehicle is unsafe to work on.

The requested tyre or wheel combination is unsuitable.

Additional authorisation is needed.

Abusive, threatening, or unsafe conduct occurs.
We will contact you before carrying out additional chargeable work that falls materially outside the agreed scope.
Completed fitting, balancing, alignment, and other service charges are not refundable for change of mind. Your legal rights remain available if a service is not performed with reasonable care and skill or fails to meet another applicable consumer guarantee.
11. Returns, exchanges, and refunds
Our Returns and Refund Policy forms part of these Terms of Service.
As a gesture of goodwill, eligible change-of-mind returns may be requested within 14 calendar days of delivery. Approved change-of-mind returns are eligible for an exchange or store credit only and must satisfy all conditions in our Returns and Refund Policy.
To qualify, tyres must be completely unused, unfitted, unmounted, undamaged, and in exactly the same condition in which they were delivered. All original labels, stickers, protective materials, and packaging must remain attached and intact.
Once tyres have been fitted, mounted, driven on, used, altered, damaged, or had their labels removed, they cannot be returned for change of mind.

12. Faulty or incorrectly supplied products
Products supplied to consumers are covered by the guarantees and remedies available under the Consumer Guarantees Act 1993.
If a product is faulty, damaged, unsafe, incorrectly supplied, does not match its description, or is not fit for a purpose we agreed to, please contact us promptly.
Depending on the circumstances and applicable law, the remedy may include repair, replacement, refund, or compensation.
We may reasonably inspect or test a product before confirming the appropriate remedy. This does not remove or reduce your statutory rights.
Manufacturer warranties are additional to, and do not replace, your rights under New Zealand consumer law.
13. Manufacturer warranties
Some products may include a manufacturer or distributor warranty. Warranty terms, coverage, exclusions, claim requirements, and duration vary between products.
Proof of purchase and evidence of appropriate maintenance, tyre pressure, rotation, alignment, and vehicle condition may be requested where relevant to a manufacturer warranty claim.
Normal wear, punctures, impact damage, road hazards, misuse, underinflation, overinflation, overloading, mechanical defects, alignment issues, racing, or unauthorised alterations may not be covered by a manufacturer warranty.
A manufacturer warranty does not limit any rights you have under the Consumer Guarantees Act 1993.
14. Website accounts and security
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.
Please notify us promptly if you believe your account or payment information has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to protect customers, Tyre Shepherd, or the security and operation of our website.
15. Website availability and accuracy
We may update, maintain, suspend, or discontinue parts of the website when reasonably necessary.
We do not guarantee that the website will always be uninterrupted, secure, or free from technical errors. However, we will take reasonable steps to maintain the website and correct material issues brought to our attention.
Information provided through articles, guides, calculators, or general website content is general information and is not a substitute for inspecting a particular vehicle or obtaining professional advice.
16. Prohibited uses
You must not:

Use the website for an unlawful or fraudulent purpose.

Attempt to gain unauthorised access to the website, accounts, systems, or data.

Introduce malware, harmful code, automated attacks, or disruptive technology.

You may view and use the website for personal purchasing and information purposes.
You may not reproduce, modify, distribute, publish, sell, commercially exploit, or create derivative works from our content without prior written permission, except where permitted by law.
Third-party trademarks, product names, photographs, and content remain the property of their respective owners.
18. Reviews and submitted content
If you submit a review, photograph, comment, suggestion, or other content, you confirm that:

It is not unlawful, threatening, defamatory, obscene, deceptive, or malicious.
You grant Tyre Shepherd a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and share submitted content in connection with our business and marketing.
We may moderate or remove content that breaches these terms, is irrelevant, contains personal information, or is otherwise inappropriate. We will not suppress genuine criticism merely because it is negative.
19. Third-party services and links
Our website may use or link to third-party services, including Shopify, payment processors, finance providers, freight carriers, mapping services, and social media platforms.
Those services may be governed by their own terms and privacy policies. Tyre Shepherd is not responsible for independent third-party websites or services outside our reasonable control.
Shopify provides the ecommerce platform used to operate our online store but is not the seller of products purchased from Tyre Shepherd.
20. Privacy
We collect, use, store, and disclose personal information in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
By using the website or placing an order, you acknowledge that information may be processed by service providers reasonably required to operate our store, accept payments, prevent fraud, fulfil orders, arrange delivery, communicate with you, and provide support.

21. Electronic communications
You agree that we may send order confirmations, invoices, delivery updates, service communications, and other transactional notices electronically using the contact details you provide.
Marketing communications will be sent only where permitted by law. You may unsubscribe from marketing messages at any time using the unsubscribe option provided.
22. Liability
Nothing in these terms excludes, restricts, or modifies liability or any right or remedy where doing so would be unlawful.
To the maximum extent permitted by law, Tyre Shepherd is not liable for loss or damage caused by:

Customer misuse, neglect, or failure to follow instructions.

Incorrect information supplied by the customer.

Installation or services performed by an unrelated third party.

Vehicle defects, wheel defects, incorrect alignment, incorrect tyre pressure, overloading, road hazards, impact damage, or unauthorised modifications.

Events outside our reasonable control.
Where liability can lawfully be limited, Tyre Shepherd’s liability will be limited to reasonably foreseeable loss directly resulting from our breach.
This section does not limit any remedy available under the Consumer Guarantees Act 1993 or other applicable law.
23. Business purchases
Where products or services are acquired for business purposes, the parties may agree in writing to contract out of applicable provisions of the Consumer Guarantees Act 1993 and Fair Trading Act 1986, but only where permitted by law and where it is fair and reasonable to do so.
Unless such an agreement is expressly made in writing, applicable statutory rights continue to apply.
24. Events outside our reasonable control
Neither party will be responsible for delay or failure caused by an event outside its reasonable control, except for payment obligations or responsibilities that cannot lawfully be excluded.
Such events may include natural disasters, severe weather, fire, epidemic, industrial action, transport disruption, supplier interruption, government action, telecommunications failure, or widespread system outage.
The affected party must take reasonable steps to reduce the effect of the event and resume performance when reasonably possible.
25. Changes to these terms
We may update these Terms of Service to reflect changes to our business, website, products, services, or legal obligations.
Updated terms will be published on our website with a revised “Last updated” date.
Changes will apply from the date they are published and will not retrospectively alter an order already accepted unless required by law or agreed with you.
26. Severability
If any provision of these terms is found to be unlawful, invalid, or unenforceable, that provision will be modified or removed only to the extent necessary. The remaining provisions will continue to apply.
27. No waiver
If we do not immediately enforce a provision of these terms, that does not mean we have waived our right to enforce it later.
28. Entire agreement
These Terms of Service, together with your order details and the policies referenced in them, form the agreement between you and Tyre Shepherd concerning your use of the website and relevant purchases.
If a specific written agreement for a product or service conflicts with these general terms, the specific written agreement will apply to the extent of the conflict.
29. Governing law
These Terms of Service are governed by the laws of New Zealand.
You and Tyre Shepherd submit to the non-exclusive jurisdiction of the New Zealand courts and tribunals.
Nothing in this section prevents you from exercising any right to bring a claim in another forum where applicable consumer law allows it.
